Misdiagnosis Claims

Our medical negligence specialists can help you secure compensation if you have suffered due to an incorrect or missed diagnosis.

Start a Claim

Can I make a misdiagnosis compensation claim?

To claim for medical misdiagnosis compensation, you must be able to show that the care you received – or the failure to care for you - caused you to experience increased pain or suffering.

If your misdiagnosis has left you in pain or discomfort, caused disability, reduced your life expectancy or has caused you to suffer in any other way, you can make a claim.

For example, you may have suffered from internal bleeding which went undetected, resulting in further injury. If you experienced increased pain and suffering as a result of the failure to diagnose and treat your injury, you may be entitled to compensation.

If you would like to talk about making a medical misdiagnosis claim, complete our online claim form or request a call back for free, no-obligation legal advice. We can help you claim on a no win, no fee basis, so you won’t have to pay legal fees unless you win your case.

What is medical misdiagnosis?

There are three types of medical misdiagnosis:

  • When an illness or condition goes completely undiagnosed by a healthcare professional
  • When the wrong diagnosis is made, and therefore the wrong medical treatment is given
  • A delayed diagnosis.

Frequently asked questions about making a misdiagnosis claim

There are many conditions and illnesses that can be misdiagnosed by medical professionals.

Some commonly misdiagnosed conditions include:

  • Appendicitis
  • Cancer
  • Diabetes
  • Fractures
  • Heart attacks
  • Heart disease
  • Internal trauma, such as internal bleeding
  • Meningitis

Some of the symptoms of these conditions and illnesses can be difficult to detect. However, they can have serious consequences, and medical professionals have a duty of care to ensure that they are diagnosed and treated correctly.

We are highly experienced at helping our clients win all types of medical misdiagnosis claims, including cancer misdiagnosis claims, breast cancer misdiagnosis claims, missed scaphoid fracture claims, and claims for delayed diagnosis of cauda equina syndrome.

Yes. If you have suffered because you haven’t received the correct diagnosis at all or in sufficient time, we can help you make a misdiagnosis claim against the NHS trust you were treated by.

We have extensive experience of helping clients claim medical negligence compensation from the NHS and private healthcare providers.

For example, we have helped many victims of jailed surgeon Ian Paterson with their medical negligence and misdiagnosis claims. Paterson operated from both private and NHS hospitals, and we have helped his former patients no matter where they were treated.

The amount of compensation you can expect to receive from a misdiagnosis claim depends on several factors. Our specialist lawyers will be able to provide you with an estimate by assessing the severity of your injuries, any costs you have had for care and any loss of earnings due to your misdiagnosis. We will obtain medical evidence to support your claim and that will also influence the amount of compensation you receive.

For an estimate of how much compensation you may be able to claim, please contact our medical misdiagnosis lawyers.

Most of our clients make no win, no fee misdiagnosis claims, which means you only  pay legal fees if your claim is successful.

If you win your claim, we cap our fees at 25% of your compensation award, so you’ll always keep at least 75% of any damages won – unlike many other claims firms who will take a higher percentage of your compensation.

The time limit for making a misdiagnosis claim is three years from the date you became aware of your misdiagnosis. There are some limited exceptions to the rule, but you should seek legal advice as soon as possible if you wish to make a claim.

If you have suffered because of a misdiagnosis, contact Thompsons Solicitors to begin a claim. Although claiming for medical misdiagnosis compensation can be complex, our specialist team will guide and support you throughout the process.

Our medical negligence experts will investigate whether you have received a misdiagnosis, if a medical professional was responsible and what harm has been caused by that misdiagnosis.

Call us on 0800 0 224 224 for free legal advice on making a misdiagnosis claim. Alternatively, start your claim by completing our online claim form. One of our specialist clinical negligence lawyers will get back to you to discuss your case.
