Our client injured his back trying to avoid a falling item at work
Cases where there may be more than one person possibly to blame can often be difficult, but that never deters us, as this week’s Case of the Week shows.
Our client worked as a warehouse operative and was required to unload goods brought in by another company. As he did this, an unsecured item fell from a pallet, and although our client managed to move out of the way to avoid being struck on the head, in doing so he injured his back.
Both our client’s employer and the company responsible for delivering the load denied responsibility.
We pushed the case all the way to trial and the Judge found that the company delivering the goods was at fault, as it had no system in place to monitor the loads of its deliveries and the pallets had not been secured properly.
Ashling King, of Thompsons Solicitors, said: “Our client was entirely blameless - the company bringing the goods into the warehouse should have ensured it had safely loaded its lorry. We will always pursue those who hide behind others to avoid liability.”
