Our accident at work team helped a woman secure compensation after suffering a head injury
Our client was a nursery worker in a Bristol-based nursery. At work, a shed used to store bikes and other outside equipment had a bolt locking system at head-height, which protruded from the shed by about five to six inches.
On the day of her accident our client gashed her head open on the bolt when putting equipment into the shed.
The employer said it could not have hung the bolt lower as it would have been a risk to children playing outside. The case went to trial and the Judge found for our client saying that there had been no assessment of the risks posed to employees, and that it was an obvious risk.
Caragh Hogan, from Thompsons Solicitors’ Cardiff office, said: “This was an accident waiting to happen. The employer had not given any thought to the dangers involved or the very simple alternatives it could have put in place.”
