Our client was walking home at night through an area with no street lighting when he lost his footing and fell into a partly-dug trench. Barriers were not properly erected around the trench at the time and there were no warning signs.
The contractors denied responsibility but a trial Judge held that had there been proper barriers around the area our client’s accident would not have occurred.
