Compensation for asbestos-related disease
A Granddad-of-two has obtained £200,000 in compensation after he was diagnosed with a fatal asbestos-related disease.
The man from Liverpool, who does not wish to be named, was diagnosed with cancer of the lining of the lung, mesothelioma, in summer 2007.
Mesothelioma is caused by exposure to asbestos and there is no cure for the disease, which can take up to 40 years to develop.
He was exposed to asbestos while employed as a labourer's mate by one of the companies which subsequently became part of Cape Plc, on the construction of a power station, Rye House, Hertfordshire.
Mixing asbestos used to insulate boiler pipes
He was responsible for mixing asbestos used to insulate boiler pipes. He had taken on the job to earn money before joining the Royal Air Force.
He instructed the asbestos claims specialists Thompsons Solicitors after contacting the Merseyside Asbestos Victims Support Group (MAVSG) for advice. The group provides support and guidance to victims of asbestos related diseases.
Thompsons was successful in securing £200,000 in compensation after producing evidence that led to a judgement being made against Cape Plc who not only denied that they had employed the client but also denied that they had been on this particular site.
The client said: “It was a hard job but it paid well. I was only doing it for the summer before joining the RAF. I had no idea that it would lead to me becoming ill so many years later.
“I decided to pursue compensation after being told I could by MAVSG. I had heard good things about Thompsons. They have done a great job and I am relieved that the claim has been settled in my lifetime.”
Exposed to asbestos while working
John Flanagan from MAVSG said: “This man was unwittingly exposed to asbestos while working for Cape Plc and as a result he is fighting a fatal disease. We are only too pleased to have helped him.”
Joanne Candlish from Thompsons Solicitors added: “Mesothelioma is a devastating disease.
“It was important to this client that his claim was dealt with quickly and brought to a conclusion during his lifetime so that he knew his family would be provided for financially.”
Asbestos disease diagnosis? Talk to us for advice and support on how to secure compensation.
If you or a loved one have been diagnosed with an asbestos-related disease, we can support you with advice on how to make a claim.
The process will be explained in plain English and with no obligation – our priority is to provide you with the best, expert advice on whether you have a valid case for compensation, and to signpost you to further sources of support.
There are strict time limits applied to making a claim – usually three years from the date of diagnosis. It doesn’t matter if the exposure to asbestos took place – as it often does – decades ago, the three year time limit applies to the date of knowledge of diagnosis or date of death.
